Marilyn Mosby, Former Baltimore State’s Attorney, Convicted of Mortgage Fraud

On January 13, 2022, Mosby was charged by a federal grand jury with perjury. The accusation stemmed from her alleged false claims of COVID-19-related financial hardship when requesting withdrawals of $40,000 and $50,000 from her deferred compensation funds under the CARES Act.

This act specifies conditions for eligible withdrawals, such as income reduction due to a COVID-related layoff or quarantine. However, it’s reported that Mosby continued to receive her full salary during this time, which had even increased.

Additionally, she was accused of withholding information about her federal tax liabilities in mortgage applications for her properties in Florida. The indictment includes four charges.

Mosby pleaded not guilty to the charges on February 4, 2022. Her trial, initially set for March 2023, faced delays when her defense attorneys were allowed to withdraw from the case due to alleged breaches of court rules. As a result, her trial was postponed further. She has been declared indigent, and a public defender has been appointed to represent her.

Mosby was convicted of perjury on November 9, 2023, facing a possible sentence of five years in federal prison for each count. On February 6, 2024, she was also convicted of making a false statement on a mortgage application, which could lead to a 30-year prison term for fraud if appeals are unsuccessful.
