Nigeria’s Court of Appeal has overturned a verdict by the Federal High Court Katsina which rendered a nullity the primary elections that led to Murtala Shehu becoming the Peoples Democratic Party’s (PDP) candidate for Malumfashi/Kafur Federal Constituency, Katsina State.
Shehu appealed the decision of the Federal High Court Katsina, which nullified the primary election results on 23 November 2022 from which he emerged the winner against Nasiru Sa’ad Ahmed.
The Court of Appeal in a unanimous decision set raise the judgment of the Federal High Court in its entirety, consequently upholding the PDP primary election held for Malumfashi/Kafur Constituency and also declared Murtala Shehu as the House of Representatives candidate for the party.
Nasiru Sa’ad Ahmed failed to respond to Shehu’s appeal leading to a default judgment by the Court of Appeal
The legal advisor of PDP Katsina, Barrister Mahutta Mustapha in his reaction to the ruling said, the judgment represents the true position of the PDP primary election which was conducted on 22 May 2022 which Murtala Shehu won.
Mr. Mustapha added that it also represents the true wish of the delegates from the Malumfashi/Kafur Constituency who voted for Murtala Shehu who garnered 34 votes as against his opponent’s 29 votes.
